A Manitoba court of appeal decision delivered Friday denied the CBC’s attempt to get Nygard’s case thrown out and opened the way for the millionaire mogul to proceed with a defamation case against the national broadcaster.
The court of appeal’s ruling essentially supports a 2015 ruling from Manitoba Court of Queen’s Bench Justice Doug Abra who, in confirming a lower court decision made two years earlier, wrote that producers of CBC’s The Fifth Estate “may be guilty of defamatory libel.”
The case is connected to a 2010 documentary that alleged Nygard was abusive to staff and known to engage in sexually inappropriate behaviour.
